Yes. Florida is a pure no-fault divorce state under Fla. Stat. § 61.052. To file, you only need to state the marriage is irretrievably broken (or that one spouse has been mentally incapacitated for at least three years). You do not need to prove wrongdoing by either spouse.
Custody is decided as time-sharing under Fla. Stat. § 61.13 using the best interests of the child standard. Florida law presumes that equal time-sharing is in the child's best interests unless rebutted by evidence on the statutory factors.
A shelter hearing is the first court hearing in a Florida dependency case after a child is removed from their home. Under Fla. Stat. § 39.402, it generally occurs within 24 hours of removal to decide whether the child should remain out of the home pending further proceedings.
